1. Service Description

Tito Fit provides fitness and wellness services including personal training, group fitness classes, fitness assessments, kinesiology services, and related health and wellness programs. Our online platform allows you to browse services, book appointments, manage your account, and communicate with our team. By using our services or platform, you agree to these Terms of Service.

2. Booking and Scheduling

When you book a service through our platform, you are entering into an agreement to attend the scheduled session. Bookings are subject to the following terms:

• Bookings are confirmed upon receipt of a confirmation email or in-app notification
• You are responsible for arriving on time for your appointment. Late arrivals may result in shortened sessions without refund
• We reserve the right to reschedule or cancel sessions due to provider illness, emergency, or unforeseen circumstances. In such cases, you will be offered an alternative time or full refund
• Session packages and credits are valid for 6 months from the date of purchase unless otherwise specified

3. Cancellation Policy

We understand that plans change. Our cancellation policy is as follows:

• 24-hour rule: Cancellations made at least 24 hours before the scheduled appointment will receive a full refund or credit
• Late cancellation: Cancellations made less than 24 hours before the appointment will be charged the full session fee
• No-shows: Failure to attend a booked session without prior cancellation will result in full charges
• Exceptions: Emergency situations and medical issues will be considered on a case-by-case basis. Please contact us as soon as possible

4. Payment Terms

Payment is required at the time of booking unless you have a pre-purchased package or credit on your account. We accept major credit cards and debit cards. All prices are listed in Canadian dollars (CAD). Applicable taxes (GST/QST) will be added to taxable services. Kinesiology services provided by a registered kinesiologist may be tax-exempt. Professional receipts suitable for insurance claims will be provided upon request for eligible services.

5. Health and Safety

Your health and safety are our priority. By using our services, you agree to:

• Provide accurate and complete health information, including any medical conditions, injuries, or medications that may affect your ability to exercise safely
• Inform your trainer immediately of any pain, discomfort, or health changes during sessions
• Obtain medical clearance from a physician before starting a new exercise program if you have any pre-existing medical conditions
• Follow the instructions and guidance of your fitness professional during sessions

6. Limitation of Liability

Tito Fit, its employees, and contractors provide fitness services in a professional manner. However, participation in physical exercise involves inherent risks. To the maximum extent permitted by law:

• You acknowledge that you participate in all fitness activities at your own risk
• Tito Fit shall not be liable for any injury, loss, or damage arising from your participation in our services, except where caused by our negligence or willful misconduct
• Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim
• We are not liable for indirect, incidental, consequential, or punitive damages

7. Intellectual Property

All content on our website and platform, including text, graphics, logos, images, and software, is the property of Tito Fit and is protected by Canadian copyright and intellectual property laws. Training programs and materials provided to you are for your personal use only and may not be reproduced, distributed, or shared without our written consent.

8. Account Terms

When you create an account with Tito Fit, you agree to:

• Provide accurate and current information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for more than 12 months.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, District of Montreal. The parties agree that the Quebec Consumer Protection Act applies to consumer transactions.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on our website and, where appropriate, by email. Your continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
